I agree with Gil almost everything on this topic, but I don't think that you have to break a law in order for the organization to step in. In my company, if someone is damaging my brand I can take action without any laws having been broken. In this case the NBA wants to protect their brand, a law shouldn't' have to be broken in order for them to step in.
