My father is a divorce attorney in Pennsylvania according to him she doesn’t have to return it if adjudicating by PA law. An engagement ring is considered a gift by PA law and by his offering the engagement ring and by her accepting it he has given it to her as a gift and so she would not be obliged to return it.

I’m on Ben’s side here. Despite what the law says, accepting an engagement ring is a promise to marry that person. If you don’t, you should return it. I think in NJ it’s considered this unless you give it as a gift (ie birthday or Christmas gift). 99% of the time it won’t matter because you’ll end up getting married anyway. If you think there’s a chance you might not get married, don’t propose.
